KXXR’s “Purple Pick ‘Em  Guess the Score” Contest Official Rules

A complete copy of these rules can be obtained at the offices of radio station KXXR-FM (“Station”), owned and operated by Minneapolis Radio Assets, LLC, located at 2000 SE Elm Street, Minneapolis, MN 55414, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

The Station will conduct the KXXR “Purple Pick ‘Em Guess the Score” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

  1. No purchase is necessary to enter or win. A purchase will not increase your chance of winning.   Void where prohibited.  All federal, state, and local regulations apply.

Eligibility.  This Contest is open only to legal U.S. residents, age eighteen (18) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”) as defined by Nielsen Audio, who have not won a prize from the Station in the last 90 days, or a prize valued at $500 or more in the last 180 days and whose immediate family members or household members have not won a prize from the Station in the last 90 days or a prize valued at $500 or more in the last 180 days.   Void where prohibited by law.  Employees of Cumulus Media, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s DMA, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren.  The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Station’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.  A PERSON, IMMEDIATE FAMILY MEMBER, OR HOUSEHOLD MAY ONLY WIN ONE (1) DAILY PRIZE DURING THIS CONTEST PERIOD.

  1. Contest Period. The Contest will begin at 9:00 A.M., CST on September 3, 2019 and will run through 3:59pm CST on December 25, 2019 (the “Contest Period”).  This Contest will not run on Sunday, November 24, 2019, due to a bye week.  Also, for the week of October 21, 2019, qualifiers will not be obtained for that week’s game after 3:59 PM CST on Wednesday, October 23, 2019, for that particular week because the game occurs on a Thursday (Thursday, October 24, 2019), rather than on a Sunday like the other games do.  For the weeks of December 2, 2019 and December 23, 2019, qualifiers will not be obtained for that week’s game after 3:59 PM CST on Friday, November 29, 2019, and Friday, December 20, 2019 for that particular week because the games occur that same night (Monday, December 2, 2019 and Monday, December 23, 2019), rather than on a Sunday like the other games do.  The Station’s computer is the official time keeping device for this Contest. There are only two (2) Grand Prizes that may be awarded in this Contest.  At the moment the second Grand Prize is awarded, participants are no longer eligible to receive the Grand Prize. 
  2. How to Enter. To enter:

 

You will automatically be entered into the Contest once you complete the following:

(i.)On-air: Weekdays during the Contest Period, listeners must be listening to 93X for the cue to text in during daily set times of once during the 9:00 AM hour, once during the 3:00 PM hour, and once during the 7:00 PM hour CST, Monday through Friday (except for week 8, which will occur the week of October 21, 2019, when qualifiers will be obtained Monday through Wednesday only) when they hear the cue to text by the on-air announcer.  When they hear the cue to text during these times, then they must be the ninety-third (93rd) person (as determined by the Station in its sole discretion) to text the correct spelled keyword, as indicated in the cue to text sounder, to 68683 during the Contest Period to be qualified to win a Daily Prize, will be entered to be in the running to become a finalist to guess the score as that week’s Purple Pick ‘Em contestant,  and entered to win the Grand Prize, subject to verification of eligibility and compliance with these Contest Rules.  The Station will award three (3) Daily Prizes each weekday during the Contest Period for a total of (up to) two hundred and thirty-three (233) Daily Prize Winners during the Contest Period.  Each phone number will be allowed to text once per keyword/entries per person, per hour, for a total of (up to) one (1) entry per hour, per phone number.  In order to obtain up to eighteen (18) entries per week during the Contest Period, you must correctly text in eighteen (18) separate correctly spelled keywords (one {1} keyword per hour).

For each week that the game will be played on Sunday, then all Daily Prize Qualifiers from Monday through 3:59 PM (CST) Thursday will be placed in a drawing to be selected as the one (1) entry that week that will be called on-air by HAMS the next day, on Friday, and asked to give their guesses for Purple Pick ‘Em.  For each week during the Contest Period when the game will be played on a Monday night, the weeks of December 2 and December 23, 2019, then all Daily Prize Qualifiers from Monday through 3:59 PM (CST) on Friday of that week will be placed in a drawing to be entered to become the one (1) finalist for the FOLLOWING week and will be called on-air by HAMS and asked to give their guesses for Purple Pick ‘Em. For the game that is played the week of October 21, 2019, qualifiers will not be obtained for that week’s game after 3:59 PM CST on Wednesday, October 23, 2019, for that particular week because the game occurs on a Thursday (Thursday, October 24, 2019), rather than on a Sunday like the other games do.   For the first week of game play, the September 8, 2019 game, there will be a total of eight (8) Daily Winners who will qualify to be in the running to be the Purple Pick ‘Em finalist that week.  For the weeks of September 24, 2019, December 8, 2019 and December 29, 2019, there will be a total of twelve (12) Daily Winners each of those weeks. For the weeks of November 3, 2019, December 2, 2019 and December 23, 2019, there will be a total of eighteen (18) Daily Winners for each of those weeks.  For all of the remaining weeks of game play, there will be fifteen (15) Daily Winners each of those weeks, who will then qualify and be in the running to be the Purple Pick ‘Em finalist for that particular week of play.

All entries must be received by 3:59 pm CST on December 25, 2019 to be eligible to be placed in the last drawing to be selected as the one (1) entry that week that will be called by HAMS and asked to give their guesses for Purple Pick ‘Em on-air on Friday, December 26, 2019 for the December 29, 2019 game and to be entered for the Grand Prize drawing.   Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.  Standard text messaging rates, as established by an individual’s wireless carrier, may apply, and Station assumes no responsibility for any fees or charges incurred for and associated with any text message sent to or from Station.  Any and all fees arising out of the transmission of a text message shall be the sole responsibility of the entrantSponsor is not responsible for telephone service outages, delays, busy signals, equipment malfunctions or any other technological difficulties that may prevent an individual from completing his or her telephone call or qualifying for the contest, or for entries submitted in a manner that is not expressly allowed under these rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.

Multiple participants are not permitted to share the same telephone number. Any attempt by any participant to submit more than one (1) entry by using multiple/different telephone phone numbers, identities, or any other methods will void that participant from further participation in the Contest.

Use of any automated system to participate is prohibited and will result in disqualification.  Station is not responsible for lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected registrations, all of which will be disqualified.  In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned the telephone number by the wireless carrier or an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Station and will not be returned.  Station reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.  No mail-in entries will be accepted.

  1. Daily Prize Winner Selection. The 93rd person to correctly text the keyword given out on-air at 9:00 AM, 3:00 PM and 7:00 PM CST each day during Contest Period  received during the Contest Period will each win a $25 Tailgate Sports Café gift card and be entered in a drawing to become that week’s finalist as the one (1) Purple Pick ‘Em contestant, subject to verification of eligibility and compliance with these Contest Rules.
  2. Purple Pick ‘Em Finalist Selection.  A random drawing will be held prior to each designated game date on or about 4:00 PM (CST) on Thursdays (for all Sunday game weeks), on or about 4:00 PM CST on Fridays (for all following Monday game weeks), and on or about 4:00 PM CST on Wednesday (for the Thursday game week) from among all eligible Daily Winners to select one (1) finalist for that week’s designated game as the Purple Pick ‘Em contestant. The selected finalist will be notified by phone between 4:00 and 5:30PM (CST) the same day the drawing occurs.   At the time of notification, if the selected finalist picks up the phone call from the Station in real time, then he/she must immediately submit to the Station their prediction of the exact halftime and final score for BOTH teams for their designated game date.  For example, an eligible score prediction will include the exact halftime and final score prediction for EACH team such as below:

Any selected finalist who cannot be reached during the initial contact attempt to the phone number provided during their Daily Prize Winning qualification, will have a detailed voicemail left, whenever this option is possible.  HAMS will then attempt to contact them again live on-air between 7:45 AM and 8:15 AM CST the following day (either Thursday, Friday, or the following Monday, depending on when that particular week’s game will be played {see below}).  If the Daily Prize Winner is still unreachable by phone after the third (3rd) attempt, then the Station will attempt to call them once more (a fourth (4th) attempt) off air to get their score predictions.  If they are still unreachable after the fourth and final attemptat the phone number provided during their Daily Prize Winning qualification, or if they not meet the eligibility requirements, or do not wish to participate in the grand prize contest will be disqualified.  An alternate finalist will then be randomly selected from among all remaining eligible Daily Prize Winners per the procedures outlined above, time permitting.  Decisions of Station in the selection and determination of the official finalist for each game, and all matters related to this contest are final.

Only the one (1) selected finalist, as solely determined and designated by Station, will be eligible to participate in the grand prize Score Prediction contest for their assigned game, for the chance to win the prize awards as outlined below.  All other entrants and semi-finalist qualifiers are ineligible to participate or win.  Finalist selection and participation is non-transferable. There are only two (2) Grand Prizes that may be awarded in this Contest.  At the moment the second Grand Prize is awarded, participants are no longer eligible to receive the Grand Prize, but will nonetheless still be able to win the Bonus Prizes.

Score Prediction Contest:  In order for the grand prize to be awarded to an eligible Finalist, the Halftime AND Final Score prediction submitted by that Finalist for their assigned game must exactly match the actual Halftime AND Final Score of the designated game they were required to predict according to the following requirements:

  • All Halftime AND Final Score predictions must be completely accurate and match the exact score with the correct team.  For example, if the actual final score of a designated game is Minnesota – 27, Chicago – 10, then a predicted final score of Chicago – 27, Minnesota – 10 or a final score prediction of 27 – 10 without specifying the associated teams will not constitute a winning entry.
  • All entries must be clear, legible and complete for each team.  Any unclear or incomplete predictions will be disqualified and will not be eligible for any prize award.
  • Only the one (1) official Daily Prize Winner/Finalist selected by Station is eligible to participate each week or win for their assigned game.  All other semi-finalist qualifiers for that game are disqualified and will not be eligible to participate or win.
  • The grand prize will only be awarded to an eligible finalist if BOTH their halftime AND final score prediction exactly matches the actual Halftime AND Final score of the designated game for BOTH teams. A Grand Prize may NOT BE AWARDED IN THIS CONTEST.
  • The bonus prize will only be awarded to an eligible finalist if EITHER their halftime OR final score prediction exactly matches the actual Halftime OR Final score of the designated game for BOTH teams.
  • BOTH Correct Halftime AND Final Score Prediction for BOTH teams:
    • $100,000 Cash, and
    • Trip for two (2) to Miami, FL for the Professional Football Championship game on 2/2/2020 per below
  • A BONUS PRIZE MAY NOT BE AWARDED IN THIS CONTEST.
  • EITHER Correct Halftime OR Final Score Prediction for BOTH teams: $1,000 Cash  
  • There are only two (2) Grand Prizes that may be awarded in this Contest. At the moment the second Grand Prize is awarded, participants are no longer eligible to receive the Grand Prize, but will nonetheless still be able to win the Bonus Prizes. 

7. Prize Awards & Delivery:  In the event of a successful score prediction, the eligible Daily Prize Winner who submitted the winning prediction will be eligible to claim the associated prize level, subject to approval and verification of compliance with these official rules.  The available prize awards are as follows:

  • BOTH Correct Halftime AND Final Score Prediction for BOTH teams:
  • $100,000 Cash, and
  • Trip for two (2) to Miami, FL for the Professional Football Championship game on 2/2/2020 per below
  • EITHER Correct Halftime OR Final Score Prediction for BOTH teams:  $1,000 Cash  

 

  1. Verification of Potential Winner. THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNERS IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner may be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable.  A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the contest prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
  2. Daily Prize. Two Hundred and Thirty-Three (233) Daily Prizes will be awarded in this Contest.  Each Daily Prize is a $25 gift card to Tailgate Sports Café, located at 6050 Nicollet Ave, Minneapolis, MN 55419. ARV of each Daily Prize is Twenty-Five Dollars ($25.00)  Odds of winning the Daily Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.  Station reserves the right to substitute any listed prize for one of equal or greater value for any reason.     
  3. Bonus Prize. Up to sixteen (16) Bonus Prizes MAY BE awarded in this Contest per the methods described above in Section 6 (a maximum of one Bonus Prize per week). IT IS POSSIBLE FOR ZERO (0) BONUS PRIZES TO BE AWARDED IN THIS CONTEST.   A BONUS PRIZE IS AWARDED If EITHER the correct halftime OR final scores are predicted for BOTH teams.  Each Bonus Prize will consist of $1,000 in cash.   ARV of each Bonus Prize not to exceed one thousand dollars ($1,000). 
  1. Grand Prize. Up to two (2) Grand Prizes MAY BE awarded in this Contest per the methods described above in Section 6. IT IS POSSIBLE FOR ZERO (0) GRAND PRIZES TO BE AWARDED IN THIS CONTEST.  The (up to) two (2) Grand Prizes will be available for reward in the contest, to the first two (2) Finalists who successfully complete the Grand Prize contest requirements (provide BOTH the correct halftime AND final scores for both teams).

  If BOTH the correct halftime AND final scores are predicted for BOTH teams, then the Grand Prize will consist of one hundred thousand dollars ($100,000 in cash and a trip for two (2) to Miami, Florida for the Professional Football Championship game on 2/2/2020 per below.  ARV of trip and cash not to exceed ten thousand dollars ($110,000).

 The Grand Prize is a trip for two (the winner and a guest) to the Professional Football Championship game in Miami, FL, which consists of Round trip coach class airfare for two (winner and guest) from the nearest major airport to the winner’s home (as designated by Sponsor) to Miami, FL.   Actual departure date, times and airline based upon availability and will be solely determined by sponsor;  Two (2)-nights standard hotel accommodations, double occupancy at a standard hotel as solely designated by Sponsor in the Miami, FL metro area; Arrival and departure dates as solely specified by Sponsor, based upon availability; $3,000 gift card or e-gift card to StubHub or other Sponsor designated ticket service provided, towards tickets to any game, event or entertainment of winner’s choice in the Miami, FL metro area during the designated travel dates.  Gift card subject to the terms and conditions of the issuing gift card provider.

ARV of the Grand Prize Trip to the Professional Football Championship game in Miami, FL not to exceed ten thousand dollars ($10,000).  Winner is responsible for all taxes associated with prize receipt and/or use.  Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received during the Contest Period and listeners participating at any given time.

Grand Prize Trip must be taken between February 1, 2020 and February 3, 2020, based on availability and subject to change.  Should Winner be unable to travel for any reason, then the Winner immediately forfeits the Grand Prize and at that time an alternate Winner may be selected by Station.  Travel dates to be mutually agreed upon by winner and Sponsor. Winner and guest must travel on the same itinerary.  Winner’s guest must be twenty-one (21) years of age or older. Grand Prize Trip is non-transferable and no substitution will be made except as provided herein at the Station’s sole discretion.

If the Grand Winner elects to partake in any or all portions of his/her Prize with no Guest, the Prize will be awarded to Grand Prize Winner only and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption.  Specific travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. ARV of Prize may vary depending upon the points of departure, ground transportation, and/or airline fare fluctuations; any difference between stated ARV and final ARV of Prize will not be awarded. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of Winner.  Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, and security charges. Once issued, tickets are nontransferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted.

There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion and to the extent permitted by law, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Any tickets and/or gift certificates/cards awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets or gift certificates/cards.  Other restrictions may apply.

Sponsor is not responsible for any travel delays or difficulty.  If travel delays or difficulty prevent arrival in time for any and all elements of trip, sponsor is not responsible for awarding any compensation in lieu thereof.  Each winner and his/her guest must travel together on the same itinerary.  Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner’s expense.  Actual value of the trip will depend on point of departure, destination and any airfare fluctuations.

Grand Prize finalist’s guest must be of legal age of majority in his/her state of residence (and at least 21) and will be required to execute and return a liability/publicity release prior to prize award.  All meals, gratuities, checked baggage fees, airline seat assignment fees, hotel resort fees, applicable taxes (including, but not limited to all local, state and federal taxes) and any other expenses not specified herein as being included in the finalist prize are the sole responsibility of the finalists.  Sponsor not responsible for late, lost, damaged or stolen luggage.  Any admission/tickets purchased or received by winner, are subject to the terms and conditions of the event, and hosting venue policies.  Seat locations, if any, will be based solely on availability.

All prize awards are non-cumulative.  A maximum of (2) grand prizes will be available for award in the contest, to the first two official finalists who successfully complete the grand prize contest requirements according to these official rules.  The grand prize portion of the contest will be concluded following the first (2) successful halftime & final score prediction attempts.  A maximum of (16) bonus prize awards (halftime score only or final score only) will be available in the contest, maximum of one per week.    If the prize winning requirements are not successfully completed by an eligible finalist during the contest period, then the contestant prize(s) will NOT be awarded.

All prize winner(s), if any, must accept delivery of prize from Sponsor, or as otherwise instructed by sponsor.  All other costs related to prize delivery and acceptance are the responsibility of winner including but not limited to taxes, title, insurance, license, and registration fees.  All properly claimed prizes will be awarded.  Prizes are non-transferable and no cash redemption or prize substitution allowed, except at sponsor’s sole discretion or as provided herein.  Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable.

Grand prize winner(s) will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded.  Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s).

Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize.  If forfeited for any reason, contestant will not receive any other prize substitution or compensation.  Total ARV of all available prize awards: $236,000.

  1. Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Station, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Station, Minneapolis Radio Assets, LLC, and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize. By participating in this contest, entrants agree to abide by and be bound by the Official Rules and the decisions of the Administrator, which shall be final in all matters relating to this contest.  In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize.

Releasees shall not be liable to any winner, entrant or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Releasees’ sole control.  No more than the advertised maximum number of prizes will be awarded for any reason.

  1. Publicity. Except where prohibited, participation in the Contest constitutes winner’s consent to use by the Station and its agent of winner’s name, likeness, photograph, voice, opinions and/or biographical information (including hometown and state) for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
  2. Taxes. All State, Local, Federal and/or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
  3. General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  4. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Station, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded. In event that a production, technical, programming or other error causes more than stated number of prizes as set forth in these Official Rules to be claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
  5. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Station in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Station is located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Station is located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Station is located. By participating, each entrant agrees that (1) any and all disputes, claims, and  causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota,  (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Minnesota or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Minnesota.
  6. Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained therein, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
  7. Contest Results.
